These Terms of Service (“Agreement”) govern all services provided by Whimson Home Services (“Contractor”, “we”, “us”, or “our”). By scheduling, approving, or receiving services, you (“Customer”) agree to be bound by these Terms.
Whimson Home Services provides HVAC services (heating, ventilation, air conditioning), appliance repair, installation, diagnostics, and maintenance.
A $79 diagnostic (service) fee applies to all service visits. This fee covers travel, inspection, and diagnosis. If Customer proceeds with repair, the fee may be applied toward the total cost. The fee is non-refundable once a technician is dispatched or arrives.
Customer agrees to provide active electricity, water, and gas where required, provide safe and unobstructed access to the work area, secure pets, and ensure safe working conditions.
Customer is responsible for removing or protecting personal property near the work area and identifying property boundaries if applicable.
Contractor is not liable for damage to personal property, including but not limited to carpets, flooring, furniture, driveways, landscaping, or nearby items.
All estimates are subject to change after inspection. Additional work requires Customer approval. Change Orders must include scope of work, price adjustment, and timeline impact.
Repairs (HVAC & Appliances): Labor warranty: up to 1 year unless otherwise specified. Parts are covered only by manufacturer warranties.
Installations (HVAC Systems): Labor warranty may vary by brand:
Up to 10 years labor warranty for major brands (e.g., Goodman, Carrier, Trane, Mitsubishi, American Standard)
Up to 12 years labor warranty for Daikin
Other brands: up to 3 years labor warranty
Warranty applies only to work performed by Contractor.
Warranty does not cover misuse or neglect, lack of maintenance, or pre-existing / hidden issues.
Regular maintenance is required to maintain extended warranty eligibility.
Payment is due upon completion unless otherwise agreed. Credit card payments may include up to 3.5% processing fee. Unpaid balances may be sent to collections. Customer is responsible for all service charges, taxes, permits, and fees.
Customer agrees that all authorized charges are valid and earned. Customer shall not initiate chargebacks for services that have been scheduled or dispatched, diagnosed, or completed in full or in part.
If a chargeback is initiated, Contractor may provide documentation such as work orders, photos, and logs. Customer is responsible for the full disputed amount, chargeback fees, and administrative costs. Contractor reserves the right to pursue collections and legal action.
Customer acknowledges that service work may involve moving equipment, accessing tight or concealed areas, and working near existing structures.
Contractor is not liable for damage resulting from pre-existing conditions, fragile or deteriorated materials, improper prior installations, hidden defects (plumbing, wiring, structure), or limited or restricted access.
Necessary access work may include cutting drywall, drilling, or disconnecting components. Such actions are normal and required.
Restoration (patching, painting, cosmetic repair) is not included unless agreed in writing.
Customer must provide clear workspace and protect valuable items. Contractor is not responsible for items not properly secured.
Contractor may stop work if payment is not made, unsafe conditions exist, or Terms are violated.
Contractor is not responsible for delays caused by material shortages, weather, government regulations, supply chain issues, labor disruptions, or events beyond control.
Contractor may use licensed and qualified subcontractors.
Contractor will remove debris and leave the work area in broom-clean condition.
To the fullest extent permitted by Illinois law, Contractor is not liable for indirect or consequential damages. Total liability shall not exceed amount paid for services.
Contractor maintains General Liability Insurance and Workers’ Compensation Insurance. Proof available upon request.
Customer is responsible for maintaining property insurance. Contractor is not liable for damages caused by fire, theft, natural disasters, or vandalism.
Calls may be recorded for quality and training. Customer agrees to receive phone, email, and SMS communication. Reply STOP to opt out of SMS.
This Agreement is governed by the laws of the State of Illinois. Disputes shall be resolved in Illinois courts.
Where permitted by law, the prevailing party may recover reasonable attorney fees.
Claims must be filed within 2 years of service completion.
Customer must allow Contractor reasonable time to correct any issue before pursuing claims.
This Agreement represents the entire agreement between parties. Changes must be in writing.
Customer consents to receive SMS regarding appointments, updates, and promotions. Message/data rates may apply. Reply STOP to unsubscribe.
Customer may cancel certain services within 3 business days where required by law. Charges may apply for completed work.
Contractor reserves the right to file a mechanics lien for unpaid services in accordance with Illinois law.
